Pecherskyi District Court in the City of Kyiv adopted a decision in favor of Hroisman, the Prime Minister

On the 17th of January 2017, Pecherskyi District Court in the City of Kyiv adopted a decision in favor of Volodymyr Hroisman, the Prime Minister of Ukraine, in a dispute with Yulia Tymoshenko on the defamation claim of the latter. The hearing, considered by Pecherskyi District Court in the City of Kyiv, concerns the criticism of Yulia Tymoshenko, who was mentioned by Volodymyr Hroisman during a briefing in the context of comparing the newly-developed social protection system with the previous one.
Oleh Gromovyi, GENTLS law firm partner, who represented Volodymyr Hroisman, commented on the decision of Pecherskyi District Court in the City of Kyiv: ‘The court dismissed the claim of Yulia Tymoshenko. I’m happy with the result and the trial as a whole. We filled the case with evidence, confirming that the statement of Volodymyr Hroisman was an assessment. For example, we have attached an expert opinion of a linguist, who found that Volodymyr Hroisman used an allegory in his statement. Under the law of information, the statements that do not contain actual data, but with the use of allegories, are not subject to refutation. In addition, the case did not prove any harm to Yulia Tymoshenko, which eliminates corpus delicti for the prosecution for statements.
